BACKGROUND/DISCUSSION:
September 1, 2020 the City Council approved the Standard Form Agreement AIA Document A133-2009 with Steele & Freeman Inc. to perform as the Construction Manager At Risk or CMAR to construct the new Central Fire Station. As stipulated in the agreement Steele Freeman will perform those services for a Guaranteed Maximum Price or GMP. In coordination with City staff, BRW Architects and Steel & Freeman, the GMP has been established. Approval of the document amendment as presented is agreement to the GMP. Amendment to AIA Document A133-2009 has been reviewed and approved by City legal counsel.
Attached are both the original Standard Form of Agreement AIA Document A133-2009 approved by City Council on September 1, 2020 and the AIA Document A133-2009 Amendment identified as Exhibit A.
FINANCIAL IMPACT:
The GPM as outlined in Exhibit A is Eleven Million Three Hundred Eighty Five Thousand and Eighty Seven dollars ($11,385,087.00). This is the sum guaranteed by Steele & Freeman, as the CMAR, not to exceed for the construction of the new Central Fire Station.

Staff recommends approval of Amendment to AIA Document A133-2009 as presented.
