SUBJECT:

PUBLIC HEARING – Consideration and Action regarding an Ordinance of the City of Saginaw, Texas, Amending Appendix A (Zoning) of the Code of Ordinances to Amend Section 7-2 Carport Overlay District; Providing that this Ordinance Shall Be Cumulative of All Ordinances; Providing a Severability Clause; Providing for a Savings Clause; Providing a Penalty Clause; Providing for Publication in the Official Newspaper; and Providing an Effective Date.

BACKGROUND/DISCUSSION:

Sec. 7-2 of the Zoning Ordinance regulates the construction of carports. The section contains a defined “Carport Overlay District” where carports are allowed. Carports outside of the district are expressly prohibited.

On March 19, 2021, City Council adopted Ordinance 2021-07 allowing carports outside of the overlay district for a Public safety facility, police and fire, located in a Community Facility (CF) zoning district.

The City has received a request from the developer of a multifamily development to consider allowing car ports within the facility. Multifamily development may or may not have covered parking provided by garages.

The proposed ordinance amendment will allow the use of carports to provide protection of tenant’s vehicles from weather.

The ordinance is proposed to be amended to read as follows:

“Sec. 7-2. - Carport overlay district.

The city has established a carport overlay district wherein such carport may be allowed and expressly prohibits carports within any area outside of the carport overlay district with the following exceptions:

1.   Public safety facility, police and fire, located in Community Facility (CF) zoning districts.

2.   Multifamily developments in MF1 and MF2 zoning districts.

3.   Carports are permitted in the carport overlay district according to the regulations contained herein.

The remaining provisions under Section 7-2 will remain unchanged.”

The Planning and Zoning Commission considered the item at its July 13, 2021 meeting and unanimously recommended approval.
