BACKGROUND/DISCUSSION:
On June 18, 2019, City Council approved a Chapter 380 Economic Development Agreement (Agreement) with AM & JK Development, LLC, the developer of The Square. The agreement provided for the installation and funding for ”ROADWAY IMPROVEMENTS” including a median opening and turn lane along U.S. 287.
The Agreement was amended twice. The first amendment was to clarify that the City direct costs associated with entering into agreements with the City of Fort Worth for a sanitary sewer metering station and with the Texas Department of Transportation (TxDOT) for a funding agreement would be the obligation of the developer. The second amendment was to clarify that the project within TxDOT right-of-way that will be awarded by the City will be the first to draw down funds to pay for the project and associated expenses such as testing and inspection before other roadway and utility cost within the development could be considered for reimbursement under the agreement.
On January 5, 2021, City Council approved a Local On-System Improvement Project Agreement (LOSA) with the Texas Department of Transportation (TxDOT). The LOSA LOSA allows City to use its bidding and award procedures and to manage the construction of the improvements within TxDOT right-of-way. Upon completion of the project and certification by the City that the project was built in conformance with TxDOT standards, the State will assume maintenance of the project.
After securing final plan approval from TxDOT the project was advertised for construction and the following bids were received on July 14, 2021:

FINANCIAL IMPACT:
The Financial Impact is $869,436.16. Funds are available from funds escrowed under the Chapter 380 Economic Development Agreement (Agreement) with AM & JK Development, LLC.
RECOMMENDATION:
Staff recommends approval of a construction contract with McMahon Contracting LP in the amount of $869,436.16 for BU 287 & Saginaw Square Boulevard Traffic Signal, South bound Deceleration Lane and North Bound Deceleration Lane
