SUBJECT:

Consideration and Action Regarding Rejection of Apparent Low Bid and Award of Construction Contract for the Traffic Signal Improvements Bailey-Boswell Road at Knowles Drive

BACKGROUND/DISCUSSION:

On March 3, 2020, City Council authorized an Individual Project Order (IPO) with Kimley-Horn and Associates, Inc. (KHA). Phase 4 of the IPO was for the design of the Bailey-Boswell at Knowles Drive Signal.

On August 18, 2020, City Council authorized the sale of Combination Tax and Revenue Certificates of Obligation to fund several projects including the preparation of the design and construction documents and construction for the Central Fire Station. There is anticipated savings in the Fire Station funds to fund the traffic signal.

The Traffic Signal Improvements Bailey-Boswell Road at Knowles Drive was advertised for construction and on July 20, 2021 the following bids were received:

Contractor

Bid Amount

Roadway Solutions Inc.

$313,961.00

Durable Specialties Inc.

$335,400.00

Bean Electrical, Inc.

$393,087.20

Tejas Utilities, LLC

$399,999.00

Road Solutions, LLC

$402,492.92

Select Maintenance, LLC

$434,545.40

The apparent low bidder is Roadway Solutions Inc. based on the bids read aloud. However, after tabulating the bids and checking the math Tejas Utilities, LLC, made an apparent scriveners error and wrote the wrong total for the their bid. The corrected bid is $299,998.99 making them the apparent low bidder. Roadway Solutions Inc., the second low bidder also had mathematical error resulting in a corrected bid of $334,311.00.

KHA performed a reference check on Tejas Utilities, LLC. The reference check indicated limited experience in traffic signal related work. Based on KHA's reference check staff is recommending Tejas Utilities, LLC's bid be rejected and that the City award the contract to Roadway Solutions Inc.

FINANCIAL IMPACT:
The Financial Impact will be $334,311.00. Funds are available in the Combination Tax and Revenue Certificates of Obligation authorized on August 18, 2020. $334,311 will be allocated from savings from the Fire Station Project.

RECOMMENDATION:
It is recommended that the bid from Tejas Utilities, LLC be rejected and that Roadway Solutions Inc. be awarded the construction contract for Traffic Signal Improvements Bailey-Boswell Road at Knowles Drive in the amount of $334,311.00.
