SUBJECT:
Public Hearing - Consideration and Action regarding Ordinance No. 2022-18, amending the City's Drainage Utility System Schedule of Charges

BACKGROUND/DISCUSSION:

The Drainage Utility was created in 2005 to fund design and construction of drainage system improvements, as well as, maintenance of the system.  Drainage utility fees were last increased in 2016.

Proposed drainage fee increases were presented to the City Council at the budget workshops on May 17, 2022 and July 5, 2022 and approved as part of the Fiscal Year 2022-2023 Adopted Budget.  Monthly fees for residential and multifamily will be $6 per unit (a $1 increase) and commercial/industrial will be $3.97 per unit (a $0.67 increase).

The revised drainage utility system schedule of charges is directly related to the drainage and terms of the levy, any classification of the benefitted properties in the City is nondiscriminatory, equitable and reasonable; the revised schedule of charges is based on an inventory of the lots and tracts within the service area, which is the entire City; the schedule of revised charges gives consideration to the land use made of the benefitted properties, the size, in area, the number of water meters, and topography of a parcel of benefitted property in assessing the drainage charges to the property.

The Texas Local Government Code has specific requirements that must be met in order to revise the charges.  A public hearing notice including the proposed fees must be published three times before the date of the public hearing with the first publication occurring on or before the 30th day before the date of the public hearing.  We have complied with these requirements with notices published on September 9th, September 16th, and September 23rd.  The fees will become effective November 1, 2022.

FINANCIAL IMPACT:
The fee increase will result in additional Drainage Utility Fund revenues of approximately $155,000 per year.

RECOMMENDATION:
Staff recommends approval of ordinance No. 2022-18, amending the Drainage Utility System Schedule of Charges.
