SUBJECT:
PUBLIC HEARING - Consideration and Action Regarding a Recommendation from the Planning and Zoning Commission, to Amend the Zoning Ordinance (No. 2001-04) Amending the Regulations for "Private Card Club" and "Bingo Halls"

BACKGROUND/DISCUSSION:

Staff has received recent inquiries about allowing a new use, "Private Card Club" within the City. Private Card Clubs have recently been permitted in Texas cities.

Private Card Clubs do not meet the legal definition of gambling as define in the Texas Penal Code. Revenue for the clubs is made from private dues from its membership.

The request was informally brought before the Planning and Zoning Commission on July 14, 2020 to receive its feedback. The Commission provided staff direction including that of treating Bingo Halls and Private Card Clubs similarly as a land use. Additionally, the Commission expressed concern over the uses being allowed along Saginaw Boulevard.

The proposed ordinance amendment adds "Bingo Hall" and "Private Card Club" as Prohibited Uses in the Saginaw Boulevard Overlay District. When allowed in other areas the uses will require a Specific Use Permit.

The “Permitted Use Table,” will be amended to read as follows:
