BACKGROUND/DISCUSSION:
On June 18, 2019, City Council approved a Chapter 380 Economic Development Agreement with AM & JK Development, LLC, the developer of The Square. The agreement provided for the installation and funding for ”ROADWAY IMPROVEMENTS” including a median opening and turn lane along U.S. 287.
The developer has been working with TxDOT to secure approval of plans for the median opening and turn lanes, including signalization. The plan approval has been secured and TxDOT has recommended that the project be built using the LOSA. The LOSA allows City to use its bidding and award procedures and to manage the construction of the improvements within TxDOT right-of-way. Upon completion of the project and certification by the City that the project was built in conformance with TxDOT standards, the State will assume maintenance of the project.
The LOSA must be executed between the City and TxDOT. The value of the construction within the right-of-way is estimated at $715,600. The total Estimated Costs by the City is $759,175 which includes $41,500 for engineering and $2,075 for Environmental paid by the developer.
TxDOT is committing $52,273 for administrative oversight on the project.
The Resolution identifies the project, identifies the funding source, confirms the City of Saginaw’s financial commitment to payment including payment of overruns, affirm that the City of Saginaw is authorized to enter into a LOSA with TxDOT and identifies the signatory authorized to enter into the LOSA on behalf of the City.
